Hospital Issued Citations for Patient Rights Deficiency, Expired Meds, and Unqualified Staff

The Centers for Medicare and Medicaid Services (CMS) cited Turning Point Hospital for violations related to patient rights, unusable medications, and dietary services following a recertification survey.

CMS surveyors found that the facility failed to uphold patient rights to information about the grievance process. They found that “the facility lacked policies and procedures regarding providing notifications to Medicare beneficiaries of their hospital discharge appeal rights.” Medicare regulations require hospitals to provide Medicare beneficiaries with an “Important Message (IM)” notice upon admission or within two calendar days, informing them of their inpatient rights. But a CMS review revealed no documentation showing that this information was provided in eight of eight sampled patient cases. The Director of Nursing stated “the facility was unaware” that they were required to provide this notice within the specified time frames.

CMS surveyors also cited the facility because it “failed to assure that outdated, mislabeled, or otherwise unusable drugs and pharmaceuticals were not available for patient use.” A random drug check in the pharmacy revealed five medications with expiration dates that had already passed. These included medication for kidney dialysis patients (Renagel), thyroid medication (Armour Thyroid), seizure medications (Zonisamide and Zonegran), and blood pressure medication (Bisoprolol).

The facility was also cited by CMS for not ensuring that its food and dietary services manager “had training and experience in management of a health care food service system.” An interview with the food services manager revealed that he/she had not received any food or dietary training. The facility had to submit a plan of correction to address its cited deficiencies and get back into compliance.
